Definitions

• A 'Client' is a person, persons, business or organisation using any of the services provided by Pipmeister Designs.
• 'Live' means the date the website is available on the Client's chosen domain.
• 'Domain' is the website address as specified by the Client.
• 'Hosting' is a yearly cost to keep a clients website activated online.
• 'Content' is both text and images that the Client requires on the website.

Terms & Conditions

• The contract between Pipmeister Designs and the Client will be on these conditions, to the exclusion of all other terms and conditions. Any variations to these conditions shall have no effect unless agreed in writing.
• An 'order' is deemed to be a written or verbal contract or agreement between Pipmeister Designs and the Client, this includes telephone and email agreements.

Limitation of Liability

• Pipmeister Designs cannot be held responsible for anything adversely affecting the Client's business operation, sales, or profitability that might be claimed as a result of a service offered by Pipmeister Designs.
• The Client must obtain permission and rights to use any data, information or files that are copyrighted by a third party. The Client is further responsible for granting Pipmeister Designs permission and rights for use of the same and agrees to indemnify and hold harmless Pipmeister Designs from any and all claims resulting from the Client’s negligence or inability to obtain proper copyright permissions.
• Unless explicitly specified in writing, it is assumed that the Client owns the intellectual property rights in any service provided by Pipmeister Designs.
• All images displayed on the Client's website or used in graphic design or print services are the sole responsibility of the Client regarding usage and copyright. Should any legal issues or claims arise from the content or copyright of any images supplied by the Client or Pipmeister Designs, they will be the sole responsibility of the Client.
• Pipmeister Designs cannot take responsibility for any copyright infringements caused by materials submitted by the client or any other copyright infringements of any kind.
• Where images used on the website or in graphic design or print services have been purchased by Pipmeister Designs on behalf of the Client, these images are strictly for that use only. Pipmeister Designs are not liable for misuse of these images by the Client or any other person's copying, altering or distributing the images to individuals or other organisations.

Indemnity

• The Client agrees to defend, indemnify and hold Pipmeister Designs harmless from any and all demands, liabilities, losses, costs and claims. The Client agrees that this indemnification extends to all aspects of the work completed by Pipmeister Designs.

Warranty Disclaimer

• Pipmeister Designs will not be responsible for any losses or damages the Client's business may suffer. Pipmeister Designs make no warranties of any kind, expressed or implied for services we provide. This includes loss of data resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions caused by Pipmeister Designs. Pipmeister Designs cannot guarantee the functionality or operations of a website or that it will be uninterrupted or error free. While every attempt will be made in the unlikely event of any corruption, software or hardware failure to restore website data and content, the Company cannot guarantee a website be restored to original state. Pipmeister Designs is not responsible for any content published on the Client's website, in graphic design or print services that infringes any law, copyright or compliance.

Website Hosting

• Whilst Pipmeister Designs recommends hosting companies to host websites, and will make appropriate arrangements for website hosting; however no guarantees can be made as to the availability or interruption of this service. Pipmeister Designs cannot accept liability for losses caused by the unavailability, malfunction or interruption of this service, or for loss of turnover, sales, revenue, profits or indirect, consequential or special loss.

Website Optimisation

• Where asked to provide search engine optimisation for a Client, Pipmeister Designs do not guarantee any specific placement or high ranking on search engines.
• The methods by which search engines determine page rankings and index positions for URLs changes frequently and often without warning. For this reason SEO is an ongoing commitment. Pipmeister Designs do not warrant that any position achieved in the listings of any specific search engine will be maintained.

Project Cancellation

• A project may be cancelled by the Client at any time in writing. In the event of cancellation any deposit paid will be non refundable. Where the cost of the work effort and expenses incurred in execution of the project up to the date of cancellation exceeds the deposit amount, the difference will be payable by the client.

Complaints Procedure

• Any Client who experiences a problem with their web service provided by Pipmeister Designs should raise the matter directly and promptly, giving sufficient information to locate the material (such as an url) and clearly outlining the grounds for complaint.
